Seller/we/our/us/Baycos – stands for NetVest sp. z o.o. sp. k., Żwirki i Wigury 12/34, 80-463 Gdańsk, registered in Poland, company registration no. 5842765987, and the company's website www.baycos.com.
Customer- stands for the person or company who buys the goods from the Seller and to whom this document is addressed.
International Customer shall mean, Customer from outside Poland.
Website/ Online Store shall mean www.baycos.com or any other subdomains of baycos.com which may be accessible unless expressly excluded by their own terms and conditions.
Order means the submission of an order for goods on the Online Store by the Customer.
1.1 These terms and conditions apply to the orders of products implemented by the Seller, hereinafter referred to as Baycos, to the buyer, hereinafter referred to as the Customer.
1.2 The Online Store is for use by individuals aged 15 and over. You should not use the Online Store if you are under this age.
2.1 The prices of goods will be as specified in the Online Store. We make every effort to ensure that the prices of the goods have been correct since the introduction to the system. However, if we discover a mistake in the price of the Products ordered, please go to point 2.4 regarding what will happen in this event.
2.2 Prices for our goods may change, but changes will not affect any order which has been confirmed.
2.3 All prices are quoted in EUR Euro and include VAT (where applicable) at the current applicable rate in the EU.
2.4 The Online Store contains a large number of products. It is possible that despite all of our reasonable efforts, some products in the Online Store may be incorrectly priced. If we find a mistake in the price of the products ordered, we will inform you of this error, and we will give you the option to make a purchase at the right price or cancel your order.
In such situation we will not process your order until we receive your decision. If we are unable to contact you using the contact details provided during the ordering process, we will treat your order as canceled and will notify you via email. It should be remembered that if the price error is obvious and can’t be recognized, and it could reasonably be considered as improper pricing, we do not have to provide products at an incorrect (lower) price.
3.1 All orders are subject to acceptance and availability. After placing the Order in Baycos, the Customer will receive the order confirmation and subsequent e-mails with the update. Receipt of confirmation and these e-mails do not confirm that the Order has been accepted by Baycos.
Acceptance of the order and conclusion of the contract between Baycos and the Customer will commence as soon as the products ordered by the Customer are sent from the Seller's warehouse to the address provided by the Customer.
3.2 Beycos will take all reasonable care in accordance with applicable laws, in so far as it is in its power to do so, to keep the details of the Customer’s Order and payment secure, but in the absence of negligence on its part (and, subject to applicable laws, including laws relating to data protection and privacy) Baycos cannot be held liable for any loss suffered by Baycos if a third party procures unauthorised access to any data you provide when accessing or ordering from the Online Store.
3.3 Products purchased from Baycos are not intended for resale or distribution. At Baycos, Baycos may limit the ordering of up to 5 individual products and reserve the right to cancel any suspicious Orders that are purchased for resale or distribution.
4. Passing of Property
4.1 Baycos shall own the property of the goods until receiving full payment for the order. After that the property shall be passed on to the Customer.

5.2 Any discounts or other promotional codes issued by Baycos from time to time are subject to strictly individual conditions with which they were issued. If any of the conditions under which the rebate codes were issued is in conflict with these conditions, the rebate code conditions will prevail.
5.4 We reserve the right to reject or cancel any orders that do not comply with these terms, even if your credit or debit card has been charged (full any amounts you have paid in connection with the order will be refunded).
Rebate codes are not transferable and have no cash value. Any code sent to you by e-mail or obtained in any way is confidential, and the customer cannot share it with any other person.
6.1 Any date or delivery period is considered to be indicative only. Our principle is to try to send all orders within one business day. All products not available at the time of ordering will be sent to you as soon as possible after receiving from the supplier. In any case, delivery will be completed within 30 days from the date of order acceptance.
If there are delays in delivery caused by the supplier, carrier or any other third party, then Baycos will contact you as soon as possible and will not be liable for such delay. In the event of a significant delay, the User may terminate the contract using the procedure described in point 10 below. In this case, the Costume will be entitled to a full refund for products that have been paid but not received.
6.2 We deliver within the territory of European Union, subject to our absolute recognition. However, restrictions may apply to certain products for certain International Delivery Destination. Before ordering goods, read the information in the online store.
If your country is not on the list and you are interested in the order, please contact us at email@example.com.
6.3 If you order goods from the Online Store for delivery to one of the International Delivery Destinations, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount.
You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.
7.1 All orders will be delivered using the services choosed at the time of ordering. All details on delivery methods can be found at www.baycos.com/delivery. Baycos has the right to price fluctuation in proportion to the cost of shipping, but the cost of delivery will always be notified before the end of the order.
8. Passing of Risk
8.1 The Customer bears the risk related to ordering products after delivery to the address given in the Order. Baycos is not responsible for undelivered shipments if the customer provided an incorrect delivery address.
8.2 If the order is lost by a third party who either been authorized by the Client to accept the products or a courier commissioned by the Client to deliver the products, Baycos does not bear the risk when it has been delivered to them. If the goods have been received as damaged, a refund will be made if we are notified about the problem within 14 days of delivery by phone or email. We can ask you to return the goods with their original packaging to the Baycos business address, see also items 9 and 10 below.
8.3 Where the goods are signed for, the customer bears the risk once the goods are signed for. If a customer believes that a parcel has been tampered with, it is their responsibility to refuse to sign for the goods (for the avoidance of doubt, signature for the parcel does not affect your rights of return under clause 10).
9. Title and Defects
9.1 The Customer shall notify the Seller on the phone or by email if the goods are faulty or misdescribed and shall be entitled to a refund, to get the product repaired or replaced or to get some of their money back (please see clause 10 below)
10. Returns Procedure
10.1 If the goods are to be rejected, the Customer shall comply with the return procedure as defined in this clause 10. Baycos will not accept any returned goods should the return not follow the aforementioned return procedure.
10.2 The Customer must follow the returns policy. This requires emailing Baycos (firstname.lastname@example.org) to notify their intention to return any goods and completing the attached Model Cancellation Form.
10.3 In cases where the rejection of the goods is due to a defect or discrepancy in the order, the Customer is entitled to a full refund within 14 days of the date of delivery of the products. The Customer must notify Baycos within 14 days of delivery and return the product to Baycos before the refund can be issued.
We will examine the returned product and will notify you of and process your refund within a reasonable period of time and, in any case, within 14 days of the day we confirm to you that you were entitled to a refund for the defective product.
10.4 In cases where the rejection occurred due to an incorrect order from the customer or dissatisfaction (where we are not at fault), the customer is entitled to a partial refund (full refund minus all shipping costs), unless the order is canceled during the withdrawal period in accordance with the point 11, in which case a full refund will be granted. The customer will however be responsible for the costs of returning the originally packed product to Baycos. You must return the goods to Baycos before partial refund.
10.5 In cases where you wish to cancel due to something we have done or are going to do, you should notify us in accordance with our returns procedure and we will refund you in full for any products not provided (including delivery costs). This includes the following:
10.5.1 Baycos have told you about an upcoming change to the product or these terms which you don’t agree to;
10.5.2 Baycos have told you about an error in the price or description or the product and you don’t want to proceed;
10.5.3 Delivery of the products has been substantially delayed by an event outside of our control;
10.5.4 The Customer has a legal right to end the order because of something Baycos have done.
11.1 Cancellations which are not due to a defect or discrepancy are only accepted if the Customer complies with the following cancellation procedure and then follows the Returns Procedure outlined in Clause 10.
11.2 Within 14 days after receiving the goods, the customer must contact Baycos at email@example.com, and must be returned to us within 14 days of informing us that you want to change your mind. The goods must be "as new" and unused, in the original undamaged packaging, including all items and gifts received. It is the client's duty to take reasonable care of the products until they return to Baycos. Baycos will consider that the customer did not exercise due diligence if the goods were used in a manner or to an extent exceeding what the customer would look at in the retail store in a similar manner before purchase and will be entitled to deduct an amount reflecting such costs in terms of your use . The return will be made within 14 days of receiving the products returned by the Customer.
12. Our Liability
12.1 If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the contract.
12.2 We only supply the products for domestic and private use. You agree not to use the product for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
14. Changes to Terms & Conditions
14.1 We reserve the right to change these terms and conditions at any time but will notify you in advance of such changes.
